Acquisition of Warner Bros. Discovery

Update: WBD & PGA

Dear PGA Members:

I am writing to update you on the work the PGA is doing to protect opportunities for producers and the future of our industry as the acquisition of Warner Bros. Discovery continues to be investigated.

As you know, producers are uniquely positioned to understand the creative and economic consequences of consolidation in our industry. It is for this reason that we have been making sure that PGA’s leadership and members are directly engaging with state attorneys general, House members, Senators, and the U.S. Department of Justice.

PGA provided official testimony to the U.S. Senate committee overseeing antitrust matters and a letter of support for the County of Los Angeles action related to the WBD acquisition. We also joined IATSE, DGA and the WGA in Burbank for a field hearing chaired by Senator Adam Schiff and featuring Representatives Laura Friedman, Sydney Kamlager-Dove, and Lou Correa.

Overall, our message to officials is focused on ensuring a competitive marketplace, and that the approval of a deal, if any, protects jobs, fosters entrepreneurship, guarantees meaningful theatrical distribution, empowers consumers with choice, promotes creativity, and upholds free speech. We’re advocating for at least the following:

  • a substantial increase in domestic production to create more American jobs;
  • a minimum of 45-60 day theatrical runs, including robust and effective print and advertising campaigns and sufficient screen counts;
  • the purchase of a meaningful percentage of productions from independent producers and other third parties; and
  • strong pro-competitive and pro-free speech conditions.

We will continue to advocate on your behalf and will keep you updated as we continue to educate these important policymakers and stakeholders. As always, please do not hesitate to reach out and share your thoughts. Additionally, we will soon be sharing a survey to collect information from the full PGA membership about consolidation and a wide range of important issues.

Thank you for your engagement and support.

Sincerely,

Susan

PGA’s Statement on Industry Consolidation

Producers are rightfully concerned about the potential sale or merger of our industry’s most storied and meaningful studios. As we hear from members, we want to share the Guild’s perspective on consolidation and our industry’s future.

For the last century, the entertainment industry has employed millions of Americans, delighted audiences, and showcased the very best of America at home and abroad. As we navigate these dynamic times of economic and technological change, our industry, together with policymakers, must find a way forward that protects producers’ livelihoods and promotes creativity and opportunities for workers and artists, choice for consumers, and freedom of speech. This is the test that potential mergers or sales of our legacy studios must pass. Within their vaults are more than content libraries – it’s the character and culture of our nation.

We continue to closely monitor industry consolidation, and will update you accordingly. As always, please reach out to us with any questions or thoughts you may have.
