The Safety Pass Training Program ("Training Program"), which includes the training courses, as well as any and all training records collected and/or maintained relating to your registration, participation, and completion of the training courses, and all elements and functionality associated therewith, are being provided to you by Contract Services Administration Training Trust Fund ("CSATTF") on an as-is and as available basis. You understand and agree to assume all risks (including, but not limited to, risks related to the accuracy and sufficiency of the Training Program to meet your particular training needs, privacy concerns related to any personal information that you provide and/or the training records, and/or issues related to ownership of intellectual property contained in the materials) resulting from your use of the Training Program. The Producers Guild of America ("PGA") does not guarantee that the Training Program, or any content on the PGA website and/or any website to which you may be redirected, will provide accurate content or materials sufficient to meet your needs. You are solely responsible for evaluating the suitability and legality of the Training Program and/or any material that you may encounter on the PGA website, or that you may access, use, develop, transmit, receive or generate in connection with your use of the PGA website or the Training Program. You hereby understand and agree to the foregoing and provide your consent to PGA to collect and provide CSATTF with, your name, email address, and any other personally-identifiable information related to your participation in the Training Program, and further agree that CSATTF may maintain and/or share certain training records with third-parties. You hereby acknowledge and agree that PGA is not, and shall not be held, responsible or liable for any personal information collected, used or stored by CSATTF in connection with your participation in the Training Program, or the quality, appropriateness, accuracy, truthfulness, completeness or legality of any communication or content related to or arising out of your use of the Training Program and/or the PGA website. With respect to your releases of liability as set forth above, you hereby acknowledge that you understand the consequences of entering into the general release and discharge of all known and unknown claims as set forth in this Agreement, and that you are familiar with the provisions of Section 1542 of the California Code, which currently provides that: A GENERAL RELEASE DOES NOT EXTEND TO CLAIMS THAT THE CREDITOR OR RELEASING PARTY DOES NOT KNOW OR SUSPECT TO EXIST IN HIS OR HER FAVOR AT THE TIME OF EXECUTING THE RELEASE AND THAT, IF KNOWN BY HIM OR HER, WOULD HAVE MATERIALLY AFFECTED HIS OR HER SETTLEMENT WITH THE DEBTOR OR RELEASED PARTY. You hereby understand and expressly waive any and all rights or benefits provided under Section 1542 and any and all similar rights or benefits under any other federal or state statutes or laws of similar effect with respect to all releases set forth in this Agreement, and you understand and acknowledge the significance and consequence of such specific waiver of Section 1542 of the California Code.
